Industrial relations (union negotiations, chairing of disciplinary hearings, CCMA matters)
We advise supervisors and managers of our clients on the appropriate actions to take in dealing with grievances or disciplinary actions. We conduct, analyse and suggest solutions for all grievances received from employees of our client. We conduct the necessary pre-hearing investigations concerning employee misconduct, and all other HR related cases. We facilitates formal disciplinary cases particularly chairing of hearing for grievances in terms of the disciplinary code and grievance procedures. We prepare and formulate disciplinary action charges and give IR/ER advice and guidance to the clients. We manage all internal disciplinary procedures and, consult and advise management on all labour issues, as well as mediate discussions between employer and employee representatives in attempt to reconcile differences. We capacitate line management, presiding officers and initiators on a disciplinary process, as well as raise awareness on labour law developments. We assist with preparation of evidence for disciplinary hearings, including preparing witnesses to testify, as well as preparing all documentation relating to CCMA cases.
We handle all IR administration. We prepare and present company arbitration hearings of our clients. We also provide union negotiations and compile case studies, and ensure IR files are prepared. We draw up, implement and ensure adherence to best practice systems that improve and maintain positive relationships between all parties. We oversee employee wellness including the collective bargaining process and ensure industrial stability through the engagement of organised labour in the development and implementation of systems and the review of conditions of employment. We provide month reports on disciplinary actions and represent our clients on arbitration proceedings. We manage all employee related processes and procedures in line with legislation and business requirements. We also develop and maintain labour law related policies and procedures to ensure compliance and also represent our clients at the CCMA and Bargaining Council, as well as co-ordinate related meetings.
We provide consultation on restructuring or business re-engineering, and also providing substantive and conditions of service negotiations. We provide HR support, advice and recommendations pertaining to grievance and disciplinary measures and also provide an HR presence during investigatory meetings and disciplinary hearings. In addition, we investigate misconduct and non-compliance cases and review appeals and provide guidance off. We explain labour legislations and provide related guidance to our clients and dvise our clients’ line managers of the implications of various disciplinary decisions they made and determine appropriate sanction for misconduct.
